ChatGPT, a generative AI chatbot, has been in the news recently for its compliance with data protection laws, specifically the EU-GDPR. Italy became the first Western country to temporarily block the advanced chatbot due to concerns relating to privacy and its non-compliance with EU-GDPR provisions. As businesses transition towards automated processes, it is becoming increasingly important to ensure that new technologies are compliant with established data protection laws. Distinguishing between personal and non-personal data is essential, as while personal data warrants protection and security, non-personal data unlocks value. Blocking/banning generative AI solutions like ChatGPT on the basis of personal data breaches and mishandling could be disproportionate.
