The fourth round of talks on a free trade agreement (FTA) between India and the EU is scheduled for March. The EU seeks unrestricted cross-border data flows, including storage, and India’s Digital Personal Data Protection Bill (DPDP) allows for data transfer, processing, and storage overseas, albeit in pre-approved countries only. The DPDP seeks to regulate only personal data, while the EU’s General Data Protection Regulation (GDPR) seeks to regulate non-personal data. India may also want to regulate non-personal data through a separate framework.
