Website operators have increasingly used chatbots to improve customer engagement and provide customer support. However, the use of these chatbots has been challenged in recent months under the California Invasion of Privacy Act (CIPA), which prohibits the use of any device to eavesdrop on or record a conversation without the consent of all parties involved. These lawsuits allege that the chatbot technology violates CIPA, and that website operators employing the technology aid and abet those violations. These lawsuits present potentially outsized results, creating early settlement leverage for the plaintiffs.
